1. Provider and scope
These terms concern the use of Ninja Splash and its online game services provided by Noel Tim Geldschläger, operator of the non-commercial hobby project Boocord Studios, Dietrich-Bonhoeffer-Straße 6, 70794 Filderstadt, Germany, email noel@boocord.com, telephone +49 (0) 151 29004766 (the “provider”).
They apply to the extent that they have been validly incorporated into the relevant agreement for use of the service when that agreement is concluded. Individual agreements and mandatory law take precedence. Merely visiting this website does not establish a paid contract or consent to optional data processing.
The Apple terms of use and licence terms validly agreed when obtaining the app through the App Store also apply, in particular the Apple Standard End User Licence Agreement, unless a different app licence has been validly agreed. These supplementary terms of use do not replace the App Store licence. Mandatory consumer rights are not restricted.
2. Access and use by minors
The app requires a compatible device and operating system; supported versions are specified in the App Store product description. Network features require a suitable internet connection, and access to online play requires an available Game Center sign-in. Connection charges imposed by your mobile or internet provider are not part of our service.
Minors may make legally binding declarations only within the limits of their legal capacity. Where authorisation by their legal representative is required, it must be obtained. The App Store age rating does not replace any required authorisation. Using someone else's Apple account does not grant any additional authority.
3. Game content, offline and online features
Ninja Splash provides local game modes, online matches, progress and unlocks. Where available, this includes leaderboards, friendships, personal blocks, parties and invitations. The specific features are those provided in the relevant app version and its product description.
In online matches, the game server calculates the authoritative game state and result. Matchmaking may fill vacant places with bots. If a connection is interrupted, a bot may temporarily take over a character; returning to the same round requires that the round still exists and the connection has been restored. An interrupted connection therefore does not carry a promise that every match or temporary state will be preserved. Statutory claims relating to a defective service remain unaffected.
No particular ranking, success rate or continuously uninterrupted internet connection is promised. Maintenance, faults and necessary security measures may temporarily affect online features. Restrictions are limited to what is objectively necessary; statutory obligations to provide the service and remedy defects remain in force.
4. Game Center, profile and account access
The visible player name is taken from Game Center. Without the relevant sign-in, a neutral name is used for local display. Access to Game Center and iCloud and management of your Apple account are governed by your relationship with Apple. The provider does not request your Apple password.
You may only use accounts and access rights you are authorised to use. Session tokens and similar credentials must not be shared for unauthorised account access. If you suspect unauthorised access, contact support and, where appropriate, secure your Apple account. Personal blocks and party visibility operate within the features offered; a private party does not imply that your public player profile is hidden.
5. Rights to use the game and its content
Under the validly agreed app licence, you may use Ninja Splash on authorised devices for your own gameplay. No additional rights to trademarks, source code, game artwork, music or other protected elements are transferred. Rights of use arising from statutory provisions and separate licences remain unaffected.
Independent redistribution, sublicensing or commercial exploitation of protected game elements is not permitted without the relevant authorisation. Restrictions do not apply where mandatory law permits an action, such as legally permitted backup copies, interoperability measures or uses under an applicable open-source or font licence.
6. Game currencies, unlocks and codes
Coins, gems, trophies and mastery points are game values with the functions described in the app. They are not legal tender, a transferable payment instrument or a balance that entitles you to a cash payout. Trading or transfers outside expressly provided features are not supported.
In the app version described here, characters, skins and other game content become available through gameplay, the use of earned game currencies or valid unlock codes. This version of Ninja Splash is free and contains no real-money in-app purchases or subscription. This website does not sell game currency. Using the service does not create a payment obligation to the provider.
Unlock codes are subject to the conditions communicated when they are issued, including any time limit, the associated content and the intended redemption per saved game. A code may only be used if it is lawfully available to you. Redemption requires a server-side check and an internet connection. Merely entering an invalid or already used code does not create an entitlement to an additional unlock. Statutory claims arising from a binding promise of a service remain unaffected.
A general change to game balance does not, by itself, authorise a material withdrawal of rights already granted. Corrections of demonstrable technical crediting errors must be understandable and proportionate.
7. Permitted use and technical protection
Prohibited conduct includes manipulating online results or access checks, using automation not provided for by the game to obtain an unfair progression advantage, accessing other people's accounts without authorisation, deliberately attacking the service's availability and unlawfully using third-party content or trademarks. Investigation and usage rights permitted by mandatory law remain unaffected.
Technical safeguards may reject unauthorised or excessive requests and temporarily limit access. They protect the infrastructure and gameplay. Ninja Splash does not include its own public chat or upload service. For technical or legal matters, the support contact in the legal notice is available.
8. Boocord Music and offline playback
The music feature allows you to select tracks and, where provided, download them locally for playback within Ninja Splash. The rights granted for this purpose cover private playback in the game, including the offline use offered.
A download does not transfer ownership of the musical work or permission to resell, publish or redistribute the file, perform it publicly or use it as the soundtrack to your own publications. Further uses, such as in publicly shared videos, require the relevant rights unless permitted by law or a separate licence.
The availability of individual tracks may change for legal or technical reasons. Statutory rights and expressly promised services remain unaffected. Separate use of the Boocord Music website is governed by its validly incorporated terms; those terms do not automatically create additional obligations for the game integration described here.
9. Updates and service changes
Necessary updates serve purposes including security, bug fixes and compatibility. Reasonable adjustments may also become necessary to support new operating systems, maintain game balance or accommodate interface changes. Where the provisions on digital products apply, changes are subject to their requirements, in particular section 327r of the German Civil Code (BGB). No general power to make arbitrary detrimental changes is agreed.
Where required by law, changes are made without additional cost and with clear information; changes that have more than a minor negative effect are subject to timely notice on a durable medium and the applicable rights to terminate or retain the unchanged product. Statutory obligations to provide updates remain unaffected.
Changes to these terms do not become binding merely through publication of a new version or your silence. Where agreement is required, it will be obtained separately.
10. Saved games, synchronisation and termination
Local saved games, Apple cloud saves and the online account serve different functions. The respective synchronisation and storage options should be considered. Deleting one set of data does not automatically delete all others. Using the backup features offered can help prevent data loss; this does not transfer statutory duties or standards of liability to you.
You may stop using the service at any time. You can request deletion of the online account through “Delete Online Account” in settings or by an authorised request to support. The privacy policy explains which data this removes. Termination or deletion of an Apple account must be arranged with Apple.
Statutory termination rights, particularly termination for good cause, remain unaffected for both parties. Terminating an agreement does not remove statutory claims that have already arisen or legally required retention obligations.
11. Defects, warranties and liability
The statutory rules on defects, warranties and liability apply. Where the provisions on digital products apply, this includes the right to have the product brought into conformity and the statutory conditions for price reduction, termination and damages.
These terms do not exclude or limit liability for intentional misconduct, gross negligence, culpable injury to life, body or health, mandatory product liability or expressly assumed guarantees. They contain neither a blanket exclusion for data loss nor a fixed liability cap. Information about technical risks does not replace the legally required standard of care.
12. Data protection
The nature, scope, purposes and legal bases of data processing and your rights are described in the privacy policy. That policy provides information about processing; a general agreement to these terms does not turn it into consent to unrestricted uses of data.
13. Language, applicable law and disputes
These terms are available in full in German and English. Both versions are intended to have the same substantive meaning. Automatic language selection or switching languages does not change statutory consumer rights. Any uncertainty is resolved under the statutory rules of interpretation; no blanket language-precedence clause to the detriment of consumers is agreed.
The relationship with the provider is governed by German law. Consumers retain the mandatory protection of the country of their habitual residence to the extent required by applicable private international law. Statutory court jurisdiction remains unchanged; no exclusive venue is imposed on consumers.
Voluntary participation in dispute resolution proceedings before a consumer arbitration body is not offered. Statutory obligations remain unaffected. You may send complaints to noel@boocord.com. Access to the competent courts remains unaffected.
If a provision is invalid or has not been validly incorporated, statutory provisions apply in its place. The remaining provisions continue to apply only within the limits of the law.
